Experience

Howard's practice is concentrated in the areas of energy, health care, and intellectual property. His experience includes:

  • Representing energy clients before the New Hampshire Public Utilities Commission, the New Hampshire Site Evaluation Committee, the Federal Energy Regulatory Commission, and the First Circuit Court of Appeals, on matters ranging from the sale of interests in nuclear generating facilities and the acquisition and operation of gas-fired merchant power plants to the licensing and operation of hydroelectric generating facilities.
  • Representing hospitals and physician groups in regulatory matters, mergers and acquisitions, employment issues, disciplinary proceedings, corporate governance, and medical staff bylaws. He has recognized expertise in health information law, including the Privacy, Security and Transactions rules issued under the Health Insurance Portability and Accountability Act (HIPAA).
  • Negotiating and drafting software development and licensing contracts and technology transfer agreements, and arguing the seminal New Hampshire case involving an employee's rights in the job-related inventions of its employees: Vigitron, Inc. v Ferguson, 120 N.H. 626, 419 (1980).
